Whether or not you can refinance a VA loan while in forbearance mainly comes down to one thing: whether or not your forbearance program falls under the CARES Act.

Under normal forbearance programs, you would need prior VA approval to include any of the delinquent payments from your forbearance period into the refinance. However, the VA has said that forbearance entered into under the CARES Act does NOT need this prior approval. As long as you meet all of the other normal conditions—including passing the net tangible benefit test, fee recoupment, and seasoning requirements—then CARES Act forbearance should not impact your ability to refinance your VA loan.

In order to qualify for the refinance, you'll also need to provide an explanation for why you went into forbearance and proof that you're no longer facing that financial hardship.
