Brexit: House of Lords must go.

House of Lords defies Brexit.

The House of Lords has voted against the clauses in the UK Iternal Market Bill that ensure the UK can continue to function as a single sovereign entity.

Last night peers voted by 407 votes to 148 to remove the clauses which pro-Rejoin campaigners believe break international law.

The Government spokesperson said in response:

"We are disappointed that the House of Lords has voted to remove clauses from the UK internal market bill, which was backed in the House of Commons by 340 votes to 256 and delivers on a clear Conservative manifesto commitment.

"We will retable these clauses when the bill returns to the Commons. We've been consistently clear that the clauses represent a legal safety net to protect the integrity of the UK's internal market and the huge gains of the peace process.

"We expect the House of Lords to recognise that we have an obligation to the people of Northern Ireland to make sure they continue to have unfettered access to the UK under all circumstances."

This is seen as a significant defeat for the government with Arch pro-EU politician Labour's Lord Adonis saying:

"I'm virtually certain the House of Lords won't now back down in its rejection of the key breaches of international law in the Internal Market Bill.

"Ken Clarke and Michael Howard both said as much yesterday, leading 44 Tory rebels as part of the majority of 268 against Johnson."

And he went on to say that because these clauses weren't explicitly part of the Tory 2019 election manifesto, then the Lords would be within their rights to insist those clauses be removed.

"Under the 'Salisbury convention,' the Lords must ultimately pass measures in the government's election manifesto. But in this case Johnson's proposal was not in his manifesto. Rather, the opposite was promised in his manifesto!

"So the Lords is on firm constitutional ground."

He said.

And then in true Remoaner fashion, he went on with the inevitable call for a Brexit Extension!

"The right immediate policy on Brexit, in the economic crisis now engulfing us, is this: we should seek, during a further extension, to renegotiate the Withdrawal Agreement to remain in the Customs Union and retain as full access to the Single Market as possible."

So Lord Adonis won't support the UK Internal Market Bill clauses because they are not in the Tory Manifesto .... but he would support what would be a reversal of government stated policy on Brexit, which was in the Tory manifesto!

Consistency does not appear to be within the scope of Lord Adonis's vocabulary.

I don't remember seeing any mention of remaining within the EU single market or customs union in the Tory Manifesto.

In fact, here's precisely what the 2019 Tory Manifesto said:

"We will keep the UK out of the single market, out of any form of customs union, and end the role of the European Court of Justice."

What could be clearer than that?

So how could the House of Lords possibly demand that the UK government goes back on that commitment?

They would claim this is an emergency so we must crawl back under EU rule.

But I say it is more of an emergency that the EU intends to break its good faith commitment, if it hasn't already done so, and use parts of the Withdrawal Agreement in bad faith to try and force the UK to kowtow to their demands.

That is why the UK Internal Market Bill clauses on the Northern Ireland Protocol exist in the first place. Because of a clear and imminent threat to our sovereignty from the bad faith EU.

I will also point out that in the Tory election manifesto it also says:

"We also want to ensure that the UK Government and its institutions are working effectively to realise the benefits of four nations working together as one United Kingdom."

With a UK government brief saying:

"The Withdrawal Agreement Joint Committee oversees UK and EU implementation, application and interpretation of the Withdrawal Agreement. The Joint Committee will also seek to resolve any issues that may arise during implementation."

Now, the problem is that the EU, during the negotiations, let on that they would be playing games, which the UK side see as a breach of the Withdrawal Agreement.
