Article 164 of Indian Constitution | Appointment of Chief Minister & Council of Ministers
Article 164 deals with the appointment, tenure, and responsibilities of the Chief Minister and Council of Ministers in a State.
According to this Article:
• The Chief Minister is appointed by the Governor
• Other Ministers are appointed by the Governor on the advice of the Chief Minister
• The Council of Ministers is collectively responsible to the State Legislative Assembly
• Ministers hold office during the pleasure of the Governor (practically based on the majority support in the Assembly)
👉 Important:
• A Minister who is not a member of the State Legislature for 6 consecutive months ceases to be a Minister
• The 91st Constitutional Amendment Act, 2003 limits the size of the Council of Ministers to 15% of the total strength of the Legislative Assembly, with a minimum of 12 Ministers
• Some States may have a Minister in charge of Tribal Welfare as specified by the Constitution
