INEC Timetable: Justice Omotosho’s Judgement Correct Even Though He Faulted Himself - Maduabuchi

The constitution gives INEC powers to conduct elections, with clear provisions to organise, undertake, and supervise them. If we aggregate these three roles, it shows Justice Omotosho’s judgement to be right. Any law, including the Electoral Act, that seeks to derogate from these powers is unconstitutional. While Justice Omotosho’s judgement is largely correct, I think the only fault is his claim that it has to be in accordance with the Electoral Act. The Electoral Act is interfering with INEC’s powers, not the other way around.
