House Resolution 8250, introduced bipartisanly by Josh Gottheimer and Elise Stefanik, requires every operating system to verify the age of every user before setup — and hands total control over the technical standards to the FTC, an unelected agency with no Congressional oversight.
For the open-source community, this is an existential threat. Linux isn't a single product — it's 600+ independent, volunteer-maintained projects. There's no budget, no legal team, and no centralized server to build a government ID verification API or a parent-child linking database. The choice becomes: build a surveillance machine you can't afford, face massive civil penalties, or simply shut down.
Privacy-focused operating systems like GrapheneOS are fundamentally incompatible with this bill. If they refuse to build a tracking API, distributing them in the U.S. becomes illegal. And "open source exemptions" won't save anyone — Colorado proved that when their carve-out was worded so poorly it didn't even cover software under the GPL license.
The name is the biggest lie of all. This bill doesn't give parents any decision-making power — it forces them to hand their child's most sensitive identity data to a centralized FTC-governed system. And the bill's definition of "operating system" is broad enough to cover smart toasters.
This isn't about safety. It's about regulatory capture — ensuring the only legal operating systems are the ones feeding corporate and government data machines.
