The biggest change is the retrogression of EB1 India, meaning some multinational executives, managers, researchers and extraordinary ability applicants who were expecting approvals may now face additional delays.
EB2 India has also become unavailable for the remainder of Fiscal Year 2026 after all available visa numbers were exhausted. This affects professionals with advanced degrees, exceptional ability applicants and many National Interest Waiver candidates. No new EB2 Green Cards can be issued until October 1, 2026, when the next fiscal year begins.
Indian investors have also been impacted. The annual quota for EB5 Unreserved visas has been fully used, temporarily pausing new immigrant visa issuances and adjustment of status approvals until October. However, Reserved EB5 categories, including Rural, High-Unemployment and Infrastructure projects, remain available.
USCIS has decided to continue using the Final Action Dates chart for employment-based adjustment of status applications. This means fewer applicants can file I-485 applications and receive benefits such as Employment Authorization Documents and Advance Parole.
