Winning Strategies for Anxiety Disorder Cases

If you are suffering with severe anxiety disorder, you know how difficult it can be to function normally in your day-to-day life. When you add the pressures of work - meeting deadlines, interacting with co-workers, supervisors, the general public, getting through 8 hours a day regularly - anxiety disorder can shut you down.

Social Security disability focuses on the impact of your anxiety disorder on work functioning. In this video I speak about the two arguments I use to win when representing clients with anxiety issues, PTSD and associated mental health conditions.

In many cases I use both arguments. The Listing argument arises from Listing 12.06 and, in my experience, generally requires that we have evidence of in-patient psychiatric hospitalizations, suicide attempts, and long standing, but unsuccessful treatment.

In addition to the Listing argument, I also will set forth a functional capacity theory of disability, using non-medical evidence such as statements from former co-workers or supervisors to document that my client would not be reliable at any type of job.

Both the Listing argument and the Functional Capacity argument require that we show that you would not be able to fulfil the requirements of a simple, entry-level job, 8 hours a day, 5 days a week.
