WATCH: Sen. Corey Booker questions Amy Coney Barrett on racial disparities in the justice system

Sen. Corey Booker, D-N.J., pointed to a study from the American Bar Association showing that a person with a felony conviction in America "is subject to 40,000 collateral consequences." He noted that in 2017, there were more arrests for possession of marijuana "than all the violent crime arrests combined" in the United States, which "overwhelmingly and disproportionately" impacted Black Americans. "My point is, you see that if a Black person is not more likely to use marijuana, but they're more likely to be convicted of a felony for it at some three to four times the rate [of non-Black Americans], I hope you can see that that means that they're going to be more likely to lose other liberties, other rights that so deeply affect their lives," Booker said, adding that "this is such a deeply affecting system that is disproportionately harming one class of citizens based upon race." In questioning Judge Amy Coney Barrett on Oct. 14, the third day of the Senate Judiciary Committee’s Supreme Court confirmation hearing, he also touched on the ongoing movement to draw attention to racial injustice in America, the sustained protests against police violence that have taken place across the nation for several months, President Donald Trump's repeated refusal to condemn white supremacy and pervasive racial disparities. "I hope you understand my heart when I look at a justice who it seems that... is going to serve on the Supreme Court and hasn't taken steps to understand the pervasiveness, the facts, the truth about cases of race that are going to come before you in a system right now that so many people feel is unjust, that those words written on the building of the Supreme Court — 'equal justice under law' — doesn't apply to them," Booker said. "Because they see, as Bryan Stevenson says, that we still live in a country where you get better treatment in the justice system if you're rich and guilty than if you're poor and innocent." The hearing came about three weeks before Election Day. The third of four days of scheduled testimony gave senators another opportunity to ask Barrett about her record and approach to the law.
