1) The elements of the crime. Do you have a prior criminal history? Does the prosecution have enough evidence to prove you’re guilty beyond a reasonable doubt?

2) Is there a victim, or is this a victimless crime? Victims have a lot of power in your case. If the victim doesn’t want to press charges, that might weigh on the prosecutor’s decision.

3) Are there any legal issues that might make the prosecutor want to pursue charges. Was there police misconduct? Government overreach?
