Griffith Grills EPA Official About Legality Of New Power Plant Regs

In a Thursday, June 19, 2014 Subcommittee on Energy and Power hearing entitled "EPA's Proposed Carbon Dioxide Regulations for Power Plants," Congressman Morgan Griffith (R-VA) grilled Environmental Protection Agency (EPA) Assistant Administrator for the Office of Air and Radiation Janet McCabe about the legality of the new rule. Griffith pointed out that the EPA is using the Clean Air Act (CAA) as a basis for this new rule, when the plain reading from the CAA excludes EPA from proposing a rule such as this.
