The Hague Convention Treaty
Hi, I’m Mia Poppe, the Managing Partner of the Law Firm of Shaw & Associates. First, thank you for viewing our video on the Hague Convention Treaty and the civil aspects of International Child Abduction and Wrongful Removal.
The world has become an increasingly smaller place with nuclear family members coming from diverse countries. The occurance of cross border or international child custody, child abduction, or child removal actions has increased.
The Hague Convention Treaty is often triggered In cross border or international actions, where parents residing in different countries are alleging that the other has wrongfully removed or wrongfully detained minor children.
In such actions, generally the threshold question is whether one or both countries are signatories of the Hague Treaty.
These cases are very FACT specific and center around many factors, with likely particular emphasis on the following:
(1) Habitual residence of the child;
(2) The Parent’s custody rights;
(3) The Aggrieved parents exercise of his or her custody rights at the time of the removal or retention; and
(4) The age of the child.
Its important to be aware that even if a parent is found to have wrongfully removed or detained a child there may be compelling legal defenses that provide for a judicially positive outcome for the parent who removed the child.
