Miami Gardens Police Officers St. Louis (00446) and Cutino (00461) fabricacated a gun charge on Milton Bernard. On January 21, 2024, Milton Bernard was arrested and charged for carrying a concealed firearm for simply trying to ask the officers a question. Brenard who was driving to work, arrived early and decided to check out the shopping center across the street from his job. As Bernard was driving his 2022 Mercedez-Benz into the shopping center, he noticed the police officers parked to the side and decided to pull over and ask the cops about a complaint that he filed with Miami Gardens Police. When Bernard got down from his car, officers St. louis and Cutino jumped out and detained him at gunpoint. The cops claim Bernard approached the police vehicle aggresively. Bernard claims he walked over to the cops and tried to ask a question. There is no footage of the initial incident; the cops did not have thier body cams activated at the time.

St. Louis and Cutino then interrogated Bernard; he explained that he was on his way to work at the Pizza Hut across the street and that he pulled up next to the officers to ask about a complaint. The officers were not satisfied with his answer; they then proceeded to look for any reason to take Bernard to jail. St. Louis and Cutino didn't like Bernard's attiude so they conspired to charge him with carrying a concealed firearm after learning that a gun was in center console of Bernard's Mercedes-Benz.

On July 1, 2023, new legislation in Florida authorized residents to carry a concealed firearm without a concealed carry license; but just in case Bernard still has a concealed carry license. He did not violate any criteria of the law.

It appears that St. Louis and Cutino arrested Bernard to simply ruin his life and to force him to spend tons of money and waste a bunch of time. Officers had Bernard's vehicle towed and his firearm impounded. The cops even refused to allow Bernard to call his job and let them know he was coming in for work.

St. Louis and Cutino even tried to file a Risk Protection Order (RPO) (Red Flag Law) against Bernard for this incident. Red Flag Laws are designed for individuals that are a threat to the public and themselves, and not a person that is just asking questions. Once a Risk Protection Order is filed with the court, a temporary injunction is automatically set and the responndent must forfeit all his firearms. Risk Protection Orders can be extended on yearly basis after a hearing with a judge.

For this incident, Milton Bernard was charged with carrying a concealed firearm and transported to the Turner-Gilford-Knight Correctional Center. He was released from jail on a $500 bond. On May 20, 2024, the charge was dropped and the case was closed by Judge Julie Nelson.
