Scheduled Caste and Scheduled Tribe Prevention of Atrocities Act

अनुसूचित जाति एवं अनूसूचित जनजाति पर हो रहे प्रताड़ना को रोकने के लिए एक कानून बनाया गया है। इस कानून को SC/ST Act कहा जाता है। संसद ने 1989 में अनुसूचित जाति एवं अनुसूचित जनजाति (अत्याचार निवारण) अधिनियम, 1989 पारित किया। इसके बाद राष्ट्रपति ने 30 जनवरी 1990 को इस पर मुहर लगाई और ये कानून लागू किया गया।

एससी/एसटी एक्ट को हिन्दी में अनुसूचित जाति और अनुसूचित जनजाति अत्याचार निवारण कानून कहा जाता है और अंग्रेजी में इसे Scheduled Caste and Scheduled Tribe Prevention of Atrocities Act कहा जाता है। इस कानून के अन्तर्गत कुल 5 अध्याय एवं 23 धाराये हैं।

जातिसूचक शब्दों के इस्तेमाल संबंधी शिकायत पर तुरंत मामला दर्ज होगा.
एससी/एसटी एक्ट में केस दर्ज होते ही गिरफ्तारी का प्रावधान है
एससी/एसटी मामलों की सुनवाई सिर्फ स्पेशल कोर्ट में होगी.

आरोपी को अग्रिम जमानत नहीं मिल सकेगी, हाईकोर्ट से ही नियमित जमानत मिल सकेगी.

एससी/एसटी मामले में जांच इंस्पेक्टर रैंक के पुलिस अफसर करेंगे.
सरकारी कर्मचारी के खिलाफ अदालत में चार्जशीट दायर करने से पहले जांच एजेंसी को अथॉरिटी से इजाजत नहीं लेनी होगी.

SC/ST Act के तहत कितनी सजा का प्रावधान है?
यह धारा अधिनियम के तहत किए गए अपराधों के लिए सजा का प्रावधान करती है। जुर्माने के साथ छह महीने की कैद से लेकर आजीवन कारावास तक की सजा का प्रावधान है।

A law has been made to stop the atrocities on Scheduled Castes and Scheduled Tribes. This law is called SC/ST Act. Parliament passed the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 in 1989. After this, the President stamped it on 30 January 1990 and this law was implemented.

SC / ST Act is called Scheduled Caste and Scheduled Tribe Atrocities Prevention Act in Hindi and in English it is called Scheduled Caste and Scheduled Tribe Prevention of Atrocities Act. There are total 5 chapters and 23 sections under this law.
A case will be registered immediately on the complaint regarding the use of caste-specific words.
There is a provision for arrest as soon as the case is registered in the SC/ST Act.
SC / ST cases will be heard only in the special court.

The accused will not be able to get anticipatory bail, regular bail will be available only from the High Court.

In SC/ST cases, the investigation will be done by police officers of the rank of Inspector.
The investigating agency will not have to take permission from the authority before filing a charge sheet against the government servant in the court.

How much punishment is there under the SC/ST Act?
This section provides for punishment for offenses committed under the Act. There is a provision for punishment ranging from imprisonment of six months to imprisonment for life, along with fine.
