In India, the Protection of Women from Domestic Violence Act, 2005 (PWDVA) is primarily a civil law aimed at safeguarding women from domestic abuse, rather than imposing direct criminal punishment. The Act allows women to seek various forms of relief, including protection orders, residence orders, monetary compensation, and custody of children. Imprisonment under this Act only arises if a person disobeys a court-issued protection order, as per Section 31, which prescribes punishment of up to one year in jail, a fine of ₹20,000, or both. Separate from this, if the abusive behavior also constitutes cruelty or harassment under Section 498A of the Indian Penal Code (IPC), the perpetrator can face criminal charges with imprisonment up to three years and a fine. Thus, the PWDVA focuses on protection and relief, while criminal liability arises either through violation of court orders or under IPC provisions for cruelty and domestic abuse.
