Kya 2018 ke baad wala amended Section 10 purane contracts par bhi apply hoga? ❌
Supreme Court ne clear kar diya:
✅ Amendment is PROSPECTIVE
✅ Substantive rights ko affect karta hai
✅ Judicial discretion ko restrict karta hai
✅ Legislature ne retrospective effect nahi diya
⚖️ Rule yaad rakhiye:
"Substantive law changes are presumed to be prospective unless expressly made retrospective."
📚 Important Cases:
• Katta Sujatha Reddy v. Siddamsetty Infra Projects Pvt. Ltd.
• Annamalai v. Vasanthi
Agar agreement 01.10.2018 se pehle ka hai, to generally unamended law
