Beaurish Tigere is a 19-year-old Zambian national who has lived in the UK since she was six. Her immigration status was regularised in 2012 whereupon she was granted three years’ discretionary leave to remain. By virtue of her immigration status she is ineligible for a student loan. This appeal considers the compatibility of statutory eligibility criteria for student loans based on i) indefinite leave to remain and ii) three years’ lawful residence with the right to education and the prohibition on discrimination.

The Supreme Court allows the appeal by a majority of 3:2.
