What's my claim worth? Issues in professional negligence litigation
Elizabeth Ovey, Wendy Mathers and Henry Day discuss issues in professional negligence litigation generally prompted by their experience of litigation relating to pensions schemes in particular and in the light of some recent cases. Aspects for consideration include contractual terms purporting to exclude liability to third parties or to limit liability; excluding liability for indirect loss; constructive knowledge and the Limitation Act; new causes of action in connection with the same subject matter; and quantification in loss of a chance claims.
