A legal analysis of Frank Castle's trial from season 2 episode 7 and 8 of Marvel’s Daredevil. As Vulture eloquently put it: “In the Marvel Cinematic Universe, the “trial of the century” does not concern O.J. Simpson, but Frank Castle. It’s finally time for the Punisher to stand trial, and thanks to just about every imaginable thing going wrong, Nelson and Murdock must defend him against District Attorney Reyes, who has a stacked deck and enough clout to steamroll our favorite tiny firm with ease.”
The trial starts with jury voir dire. For inexplicable reasons the judge is mad at counsel for their inability to find an unbiased jury. Things go off the rails from there. At lot of good procedure, but right off the bat, the judge should have declared a mistrial. Still, fun to talk about reserving opening statements, federal rules of evidence, and expert cross examinations.

I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.
Today I'm taking a break from representing clients and teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.
