DETAINED! By Paranoid BULLIES With BADGES!

Although I never asked them if I was being detained, I could reasonably be expected to believe so by the fact that my vehicle was blocked in, as is clearly shown in the video (U.S. v. MENDENHALL; U.S. v. BRIGNONI-PONCE).

In order to violate my Fourth Amendment right to be free from the seizure of my person, the police must be able to articulate a reasonable suspicion based upon evidence that I have been or am about to be engaged in criminal activity (BROWN v. TEXAS).

When Lt. Gray told me that he would have gotten my ID whether voluntarily or by force, I told him that he had no legal grounds to demand my identity. He told me, "You have your opinion of the law, I KNOW the law." My refusal to answer questions or provide ID furnished no basis for arrest (TERRY v. OHIO).

Yes, I was on police property (where I had a perfectly legitimate right to be), and they could have arrested me for trespassing ONLY IF I had refused to leave after being asked to do so... but I was never asked to leave.

On the following day, I had a meeting with a different lieutenant from this police department who informed me that I am permitted to park in the department's parking lot because my wife is employed there. He also gave me permission to film anything I wish to film from the parking lot.

The thing that bothers me the most about this incident is that I was unlawfully detained by no less than nine officers, and not one of them had either the knowledge or the courage to honor their oath to uphold the rights enshrined in the U.S. Constitution by preventing their fellow officers from violating my Fourth Amendment right to be free from unreasonable search and seizure. They are either unaware of Supreme Court case law, or they have no respect for it. Either way, I believe that this department needs to learn to respect the rights of the people it is charged to serve.

The Declaration of Independence says: "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men..."

That's right. Our government (i.e. this police department) exists to 'secure [our God-given] rights'. Unfortunately in my experience, this particular government entity believes that it exists to violate rights with impunity. They believe that they can detain anyone without evidence that a crime has been committed, that they have a right to obtain the identities of private citizens without probable cause that a crime has been committed, and that they have a right to lock a law-abiding citizen in a cage until their identity can be ascertained.

This is no small matter and should be cause for concern for every free citizen who places any value on civil liberties. A police department that is willing to disregard its oath to faithfully uphold the Constitutional rights of its citizens is a danger to the community it serves and detrimental to society as a whole. These rogue servants have forgotten their place and must be called to account by their masters, We The People.

At the very minimum, these officers need training in case law. If they continue on the course they are currently on, it is only a matter of time before the good taxpayers in this community are forced to pay a handsome penalty for the ineptitude of their public servants. These officers need to learn that they are paid to PROTECT the rights of the people, not to TRAMPLE on them.
