Settler colonialism is an ongoing project, not a historical event.

As long as a settler society is operating its institutions, land titles, and legal architecture, the colonial relationship is still fully active today.

As Chisom points out in this episode, military force is never enough to sustain the settler structure indefinitely, it requires the law. It needs a legal architecture designed specifically to convert dispossession into legitimacy.

Every settler regime uses different doctrines, but they all rely on the same fundamental legal fiction: emptying the land of its Indigenous inhabitants on paper, so the settlers can claim they discovered "empty space."

But Indigenous nations are not historical curiosities. They are sovereign people whose continued existence is, by the very logic of the settler structure, an unsolved problem.
